|COMMISSION TERMS|

By purchasing my products or services, you automatically agree to the following conditions; please read entirely and carefully.Your commission can be refused or rejected at any time, without refund if you do not agree to these terms. If you have any questions, please contact me at the provided links.+ If for any reason you wish to cancel a project, refunds will not be given.
Prices are non-negotiable and will be charged at the beginning of the project.
+ I reserve the right to adjust the timeline and availability of all projects.+ I do not allow my art to be used for AI purposes, training and the like. DO NOT upload to any AI site, app, or program as this could compromise the integrity of my artwork.+ NFT usage is strictly forbidden. No resale, MINT, or exchange of any kind.+ All rights are retained by the artist for the image itself, to display on any personal website, portfolio or future commission references.+ All art pieces are for private use ONLY, no podcast, live play, vtuber, VR upload, or mass production of the image is allowed unless a contract has been made prior.

|GENERAL USE|

+ You the Client will be expected to first read and agree to the TOS before any work or payment begins.+ You the Client may display my work on external sites as long as it is visibly credited and linked back to at least one of my host sites.+ You may not upload or host my work in any gallery that is intended to display as your own work, or claim it as your own.+ All Artwork is only for personal use unless otherwise prior contracted, including but not limited to: profile photos, phone or computer wallpapers, and other temporary displays+ You may NOT use the artwork for redistribution of any kind, commercial or non-commercial, including but not limited to apparel, prints, flyers, stickers, and other media.+ You are NOT authorized to change, modify, edit, or use the artwork in any format other than the prior agreed upon way without written permission and approval.+ Artwork is not to be traced, based, or duplicated and edited in any format.+ All artwork is subject to the ToS regardless of changes to Terms before or after the issue of services.+ Artwork may contain signatures or watermarks to indicate intellectual property; these are not authorized for removal of any kind.+ All orders assume you have read and agree to these terms of use.

|ADOPTABLE DESIGNS|

+ All Adoption Designs are single use and will only be sold to one party, one time.+ Resale of Designs by the You the Client is not allowed and will be considered a breech of transaction policy in which the design will be reclaimed by me for whatever purpose deemed reasonable with no required refund or consultation. You will be blacklisted and barred from further commissions and interactions.+ No changes or manipulations are allowed within the file (color manipulation, paint over, ect). HOWEVER, minor adjustment to the design in recreation after purchase to the character is at the discretion of You the Client.+ Credit for the original design and file will remain with me, the artist, and You the Client agree and understand that the image may be used to advertise or display my work on multiple platforms. This will not require any consultation or linking back to the purchaser of the design.+ NOT for commercial use! DO NOT for streaming/podcasting/ect.+ There will be no holds on Adoptable Designs, all items are listed in the shop for one time purchase on a first come first pay basis. If no payment is rendered, the transaction will be considered void and the Design will remain available for purchase.

|IMAGE RIGHTS|

+ I reserve the right to sign and/or watermark my own work. I will send you a full resolution image (by email or via cloud host), but my signature may remain on both the full resolution and smaller versions of the Artwork.+ You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.+ I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may use the art for any purpose (eg. post it to other sites, on flyers, personal marketing) but will credit you for ownership of the character’s design.+ In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.+ In the case of an adoptable design, I will not reuse/resell the rights to the design once original purchase is made.

|PRIVACY CLAUSE|

+ If you wish for your request to be private, it must be stated during the ordering process.+ I reserve the right to charge a fee if I deem fit.+ The NDA fee usually starts at +5% of the total quote, but it may differ depending on the workload of the project.+ The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to stream the process of the commission anywhere. However, this also means that You the Client must refrain from sharing any content of the image online as well until the agreed upon completion or display date.

|PAYMENT|

+ Payment is made in USD to Paypal or through Ko-Fi's payment playform.+ I am not responsible for any mistakes that are made on your part over the course of the transaction.+ You the Client are responsible for making currency conversions.+ Full payment is due upfront before I start any work. No exceptions.+ I will send an invoice through Paypal to initiate the transaction to avoid accidental payments. Do not send me any kind of payment until I have confirmed I can accept your commission, set the price, and have sent the payment invoice. (This does not apply to items listed in the Ko-Fi shop for instant purchase.)+ I will cover the Paypal fees as it is expected from the Artist per PayPal ToS. What you see is what You the Client will pay as total price.+ I do not accept payment from minors or shared/parental accounts. If the account is not in your name, attached to your verified email the commission and any transactions will be cancelled.+ If payment is not made in a timely manner (24h) after the invoice is posted, the commission will be cancelled. Repeated counts of commissioning a project and failing to pay will result in blacklisting.+ As a disclaimer for Paypal services, please note that all sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client. Nothing is ever intended by either me or the Client, to be physically shipped.+ Purposefully issuing a chargeback without contacting me to discuss a cancel/refund of a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.

|QUEUES AND TIMELINE|

+ Response to initial requests may take 3-5 business days.+ You may set a deadline for your commission but it must be disclosed prior to payment. I reserve the right to decline a commission if the timeline does not allow enough room for error.+ Commissions are not handled on a first come first serve basis, this means that the queue may change depending on complexity and rush orders at any time.+ I reserve the right to change the timeline of work at any point in the process, but must notify you if the expected completion date is beyond excusable difference.+ You may choose to enact a Rush Fee which can be up to 25% of the commission total. This may vary depending upon complexity and project deadlines.

|REVISIONS AND FEEDBACK|

+ Once payment is received, I will begin work on your project. You will receive at minimum three or more progress photos to give feedback on to make changes during the art process. This will come at the sketch stage, the lineart stage, and the flat colors stage. More may be sent as needed to clarify adjustments.+ These may come in the form of a .jpg or .png and can be sent through DM or Email and are not to be considered as final projects or services rendered in any fashion.+ It is the responsibility of You the Client to communicate any unsatisfactory elements in the design and artwork during the revision process. If no changes are communicated, you will not receive any leeway to make adjustments further downline or received any refund or credit considerations.+ I reserve the right to reject certain major changes at different points in the artwork process. (ie. if rendering is started, major changes to base linework will be denied)+ I reserve the right to request a fee for egregious changes or major changes made downline such as the example listed above. Fee will start at 5% and increase depending on complexity.+ In the absence of any feedback, it will be assumed the client agrees to the image as is and no changes will be made. No commission or project is valid for any revisions after services rendered are considered complete.

|FILES AND STORAGE|

+ You the Client are responsible for saving, storing, and maintaining the quality and integrity of your file once services are rendered and the transaction is completed.+ I may keep files on hand for a finite amount of time but I do not guarantee any image hosting, file storage, or project saves of any kind once the transaction is ended.+ Local and Cloud storage can be unreliable, I do not take responsibility for any loss or corruption of projects or files. During the art process, back ups will be made to prevent loss, but nothing is promised and this means that timeline adjustments may occur.+ In the even a file is lost during production, slight changes due to artistic style and the handmade nature of the project are to be expected and accommodated.
